Terms of Service
Agreement
These terms apply to xpsdstudios.com and to services provided by XPSD, a creative studio operated by Brandon Schwartz in Fort Lauderdale, Florida. By using the site or engaging us for work, you agree to them. A signed proposal or contract for a specific project takes priority over these terms where they differ.
Services
XPSD provides brand identity, content and photography, film and video, growth strategy, and related creative and marketing services. The scope, deliverables, timeline, and price for each project are set out in a proposal, invoice, or contract before work begins.
Payment
- Projects are invoiced as agreed, typically with a deposit or retainer to reserve dates and begin work, and the balance due before final delivery.
- Payments are processed securely by Stripe. Invoices are due by the date shown on them.
- We may pause work or withhold final files while an invoice is overdue.
Payments to partner businesses
XPSD also operates payment and invoicing tools for partner businesses. When you pay an invoice issued by another business through these tools, that business is the seller, appears on your statement, and is responsible for the goods or services and for its own refund terms. XPSD may receive a service fee from the partner business on those payments.
Revisions and approvals
Each project includes the revision rounds stated in its proposal. Additional changes or work outside the agreed scope are quoted separately before we begin them.
Ownership and use of work
Once a project is paid in full, you receive the rights to the final deliverables described in your proposal for your business use. XPSD keeps ownership of drafts, unused concepts, and source files unless agreed otherwise, and may show completed work in our portfolio unless you ask us not to in writing.
Cancellations and refunds
See our Refund Policy.
Limitation of liability
Our total liability for any claim related to a project is limited to the amount you paid XPSD for that project. We are not liable for indirect or consequential losses, such as lost profits.
Governing law
These terms are governed by the laws of the State of Florida. Any dispute will be handled in the courts of Broward County, Florida.
